Guatemala: Urgent Action Appeal update

EI issued a letter to its Latin American colleagues on 8 December, urging them to step up their solidarity with Guatemalan affiliate, the Sindicato de Trabajadores de la Educación (STEG).

An Urgent Action Appeal was launched on 30 June for STEG after its offices were raided by security forces on 25 and 26 June. Office equipment was taken away and furniture destroyed.

The event was a direct result of the participation of STEG General Secretary, Joviel Acevedo, in the social movement against the adoption of the US-Central America Free Trade Agreement (CAFTA). An arrest warrant was issued for him, and EI immediately referred the matter to the country's President on 17 March. STEG appealed to the Inter-American Commission of Human Rights, which recognised that Acevedo was under threat.

However, Joviel Acevedo recently received notice of a legal action initiated by the Ministry of Education with the objective of discharging the General Secretary of STEG from his position as a teacher at the Oficial Urbana Mixta '20 de Octubre' Jornada Vespertina School, on grounds that he abandoned his job on 3 January this year. The Ministry of Education claims he left his job without having the required permit, even though he is the elected leader of the union.

EI strongly condemns such a move and strongly urges all affiliates and partners to show their solidarity. For more information, please read our Urgent Action Appeal dated 30 June 2005. La Internacional de la Educación en representación de 30 millones de docentes, correspondientes a 348 organizaciones, de 166 países, afiliadas a nuestra Federación Sindical Mundial, se dirige a ustedes para expresar nuestra profunda preocupación y extrañeza sobre lo que viene sucediendo con el profesor y destacado dirigente sindical Sr. Joviel Acevedo, Secretario General del Sindicato de Trabajadores de la Educación de Guatemala (STEG).

Hemos sido informados que el profesor Joviel Acevedo a recibido informalmente una Cédula de Notificación de Cargos, por lo que esta sujeto a un proceso de destitución del cargo docente que el ostenta en la Escuela Oficial Urbana Mixta “20 de Octubre” Jornada Vespertina. Reiteramos la preocupación por el procedimiento inusual de notificación y la desinformación de tiempos para una legítima defensa, derecho consagrado en todas las Constituciones.

Así mismo, manifestamos que el compañero tiene Medidas Cautelares desde el 12 de junio del 2005, otorgadas por la Comisión Interamericana de Derechos Humanos de la OEA, ante la persecución política, ideológica y sindical, situación que su gobierno no ha dado cumplimiento a la protección necesaria que dichas medidas implican.

En consecuencia, solicitamos a ustedes dejar sin efecto esta notificación y que el profesor Joviel Acevedo pueda continuar su labor profesional, al mismo tiempo con ese gesto darán una señal del respeto a la autonomía sindical, que es lo que corresponde en un Estado de Derecho.
